1. Acceptance of terms
By downloading, installing, or using PeerDrop ("the App"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the App.
These terms apply to all versions of PeerDrop including the macOS app, iOS app, and Linux application.
2. Description of service
PeerDrop is a peer-to-peer file transfer application that allows users to send files directly between devices without using cloud storage or central servers. The App uses the Hyperswarm distributed hash table for peer discovery and the Noise protocol for encrypted connections.
PeerDrop does not provide storage, hosting, or relay services. All file transfers occur directly between end-user devices.
3. Permitted use
You may use PeerDrop to:
- Transfer files between your own devices
- Transfer files to other people with their consent
- Use the App for personal, educational, or commercial purposes
- Inspect, modify, and distribute the source code under the applicable open source license
4. Prohibited use
You may not use PeerDrop to:
- Transfer content that is illegal in your jurisdiction
- Distribute malware, spyware, or other harmful software
- Transfer files to someone without their knowledge or consent
- Circumvent any applicable laws or regulations
- Harass, threaten, or harm any person
- Infringe on the intellectual property rights of others
5. Open source license
PeerDrop is open source software. The source code is available on GitHub under its applicable open source license. Your rights to use, modify, and distribute the source code are governed by that license, not these Terms of Service.
The PeerDrop name and app icon are not covered by the open source license and may not be used without permission.
6. Disclaimer of warranties
PeerDrop is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. You use PeerDrop at your own risk.
7. Limitation of liability
To the fullest extent permitted by applicable law, the developers of PeerDrop shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or damage to hardware, arising from your use of or inability to use the App.
Our total liability for any claims arising from your use of PeerDrop shall not exceed the amount you paid for the App (which is zero, as PeerDrop is free).
8. Your responsibility for transfers
You are solely responsible for:
- All files you send using PeerDrop
- Ensuring you have the right to send any files you transfer
- The security of your own device and cryptographic seed
- Who you share your Peer ID with
If you lose your cryptographic seed, your identity cannot be recovered. We have no way to help you recover it.
9. Modifications to the App and terms
We reserve the right to modify or discontinue PeerDrop at any time without notice. We also reserve the right to update these Terms of Service. When we do, we will update the effective date at the top of this page.
Continued use of PeerDrop after any changes to these terms constitutes your acceptance of the new terms.
10. Governing law
These terms are governed by and construed in accordance with applicable law. Any disputes arising from these terms or your use of PeerDrop shall be resolved in the appropriate courts of the applicable jurisdiction.
11. Severability
If any provision of these terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining terms will remain in full force and effect.
